You might be qualified for an employment-based, first-preference visa if you are an alien of extraordinary capability, are an exceptional teacher or researcher, or are a particular multinational executive or supervisor. Each occupational category has specific requirements that must be met:

Your petitioning employer must be a U.S. company and intend to utilize you in a supervisory or executive capability. The petitioner should have been doing organization in the U.S. for a minimum of 1 year, as a legal entity with a qualifying relationship to the entity that used you abroad in a managerial or executive capacity.

No labor accreditation is needed.

* Criteria for Demonstrating Extraordinary Ability

In order to show you have sustained national or worldwide recognition which your accomplishments have been acknowledged in your field of competence, you should either include proof of a one-time achievement (significant internationally-recognized award) or 3 of the 10 listed criteria below (or equivalent evidence if any of the criteria do not readily use):

- Evidence of receipt of lower nationally or worldwide acknowledged rewards or awards for excellence

- Evidence of your subscription in associations in the field which demand outstanding accomplishment of their members

- Evidence of released material about you in expert or major trade publications or other major media

- Evidence that you have actually been asked to evaluate the work of others, either separately or on a panel

- Evidence of your original clinical, scholarly, artistic, athletic, or business-related contributions of major significance to the field

- Evidence of your authorship of academic short articles in expert or major trade publications or other major media

- Evidence that your work has been shown at creative exhibits or showcases

- Evidence of your performance of a leading or crucial function in recognized organizations

- Evidence that you command a high wage or other significantly high reimbursement in relation to others in the field

- Evidence of your industrial successes in the carrying out arts

** Examples of Documentary Evidence That a Person is an Impressive Professor or Researcher

In order to demonstrate you are an exceptional teacher or scientist, you must include proof of 2 of the 6 listed criteria listed below (or comparable proof if any of the requirements do not readily use):

- Evidence of receipt of major rewards or awards for outstanding achievement

- Evidence of subscription in associations that need their members to demonstrate exceptional achievement

- Evidence of published product in expert publications composed by others about the alien's operate in the scholastic field

- Evidence of participation, either on a panel or separately, as a judge of the work of others in the same or allied academic field

- Evidence of initial clinical or academic research contributions in the field

- Evidence of authorship of academic books or posts (in academic journals with global circulation) in the field

Application Process

Extraordinary Ability: You might get yourself by filing a Type I-140, Petition for Alien Worker.

Outstanding Professors and Researchers: Your U.S. employer should file a Form I-140, Petition for Alien Worker. As part of the application procedure, employment your employer should be able to show a continuing ability to pay the used wage as of the priority date. Your employer might use an annual report, federal tax return, or audited monetary statement to show a continuing ability to pay your wage.

Multinational Manager or Executive: Your U.S. employer need to submit USCIS Form I-140, Petition for Alien Worker. As part of the application process, your employer needs to be able to show a continuing ability to pay the provided wage as of the priority date. Your company might use an annual report, federal tax return, or audited financial statement to show a continuing capability to pay your wage.
